{"id":15804,"date":"2021-12-20T15:37:51","date_gmt":"2021-12-20T14:37:51","guid":{"rendered":"https:\/\/dev.andersen.dotandmedia.com\/?p=15804"},"modified":"2021-12-21T14:49:40","modified_gmt":"2021-12-21T13:49:40","slug":"transparency-obligations-in-public-payments","status":"publish","type":"post","link":"https:\/\/dev.andersen.dotandmedia.com\/en\/transparency-obligations-in-public-payments\/","title":{"rendered":"Transparency obligations in public payments"},"content":{"rendered":"<p>Legislative Decree 52\/2021 has <strong>extended the deadline for the application of sanctions for the year 2021 to January 1, 2022<\/strong>, against companies and non-commercial entities that have not complied with the publication of the complete and detailed list of aid and public grants not of a general nature received during the previous year, for a total amount exceeding 10,000 euros.<\/p>\n<p>In fact, starting from January 1, 2022, failure to comply with this requirement will result in a <strong>penalty equal to 1% of the amounts received<\/strong>, with a minimum amount of 2,000 euros, as well as the ancillary sanction for compliance with the publication obligations.<\/p>\n<p>After 90 days from the dispute without the transgressor having complied with the publication obligations, the sanction of <strong>full restitution of the benefit<\/strong> is applied.<\/p>\n<p>The aids covered by the publication are those other than those of a general nature received from the State:<\/p>\n<ul>\n<li>Regions, Provinces, Municipalities, Mountain Communities and their consortia\/associations<\/li>\n<li>Universities<\/li>\n<li>Autonomous institutes for public housing<\/li>\n<li>Chambers of Commerce and their associations<\/li>\n<li>National, regional and local non-economic public bodies<\/li>\n<li>Administrations and companies of the National Health Service<\/li>\n<li>Agency for the Negotiation Representation of Public Administrations (ARAN)<\/li>\n<li>Tax Agencies<\/li>\n<li>Publicly controlled companies.<\/li>\n<\/ul>\n<p>The <strong>information to be provided for State Aid<\/strong> not on the RNA (National Aid Register) site is:<\/p>\n<ol>\n<li>name of the disbursing entity<\/li>\n<li>amount collected (for each individual underlying legal relationship)<\/li>\n<li>date of collection.<\/li>\n<\/ol>\n<p>From an operational point of view, <strong>advertising is completed alternatively in the Explanatory Notes or on the website or digital portal<\/strong>, depending on the beneficiary.
