The publication of the new Decree-Law no. 19\/2020, just published in the Official Gazette, integrates the Cura Italia decree and the Prime Ministerial Decree of 22 March, typifying the urgent measures that can be adopted<\/strong> against the spread of Covid-19 and defining the relationship between the measures adopted by the Government and those of the Regions<\/strong>.<\/p>\n

The measures adopted by Decree of the President of the Council of Ministers, on the proposal of the Minister of Health or the Presidents of the Regions, are valid on the entire national territory or on specific parts of the territory for predetermined periods<\/strong>, the duration of which must not exceed 30 days<\/strong>.<\/p>\n

Exclusively in the case of extreme necessity and urgency for situations that have arisen, pending the adoption of the Prime Minister’s Decree, the Minister of Health or the Region concerned may intervene.<\/p>\n

Decree-Law no. 19\/2020 also provides for the list of urgent 29 measures<\/strong> that may be introduced in the future<\/strong>, thus classifying the applicable containment measures.<\/p>\n

The new penalty system for those who do not comply with the provisions establishes an administrative sanction from a minimum of \u20ac400 to a maximum of \u20ac3,000<\/strong>, which can be increased up to a third if the violation is committed through the use of a vehicle. The sanction also applies to violations committed before<\/strong> the entry into force of the Decree, in the minimum amount reduced by half. The penalties provided for in the previous measures have been decriminalised.<\/p>\n

In addition, an accessory penalty is provided for the closure of the business or activity<\/strong> from 5 to 30 days for the violation of the measures listed in the circular.<\/p>\n

With regard to possible overlaps between the regional ordinances and the Prime Ministerial Decree<\/strong>, the Decree establishes that the Regions may introduce the 29 measures listed in the provision, which remain in force until a new Prime Ministerial Decree.<\/p>\n

It is also specified that the Regions may adopt the above measures exclusively within the scope of the activities for which they are responsible and, in any case, without affecting in any way production activities and activities of strategic importance for the national economy.<\/p>\n

Finally, the measures still in force at the publication of the new Decree remain in force for a further 10 days<\/strong>. And the measures already adopted with the Prime Ministerial Decrees of 8, 9, 11 and 22 March 2020 continue to apply within the original terms.<\/p>\n
