Copyright enforcement in yachts design
The trend of many arch-stars to design not only buildings but also luxury boats raised several doubts regarding the application of copyright in the nautical sector.
The Associate Partner Gilberto Cavagna clarifies that even the design of luxury boats enjoys intellectual property rights. The expert analyzed a sentence of the Court of Genoa on the violation of the rules on competition and, precisely, the right author, by a boat building company against another competing one.
The Court also underlined how boats also include creative components and forms dictated only by the aesthetic sense and not by the mere solution of a technical problem. For this reason, the project designed by an architect is protected by copyright legislation.
