Law Decree Ristori – New indemnity for seasonal workers in tourism, thermal establishments and show business

An indemnity of 1000 euros is recognized as per art. 15 of Law Decree 137/2020:

  • to seasonal employees in the tourism sector and thermal establishments who have ceased involuntarily the employment relationship in the period between January 1, 2019, and the date of entry the present decree-law and who have worked for at least thirty days in the same period, who do not have a pension, nor an employment relationship, nor NASPI, on the date of entry the present provision comes effect;
  • to workers in temporary employment, employed by user companies operating in the tourism sector and thermal establishments, who have involuntarily terminated the employment relationship in the period between January 1, 2019, and the date of entry the present decree and who have worked for at least thirty days in the same period, who do not have a pension, nor an employment relationship, nor NASPI, at the date of entry into force of this decree;
  • employees and self-employed persons who have ceased, reduced or suspended their activity or employment relationship, provided they belong to one of the following sectors: seasonal employees belonging to sectors other than tourism and factories, intermittent workers, employed for home sales (with an annual income in 2019 of more than 5,000 euros) and self-employed workers, without a VAT number, not registered in other compulsory social security forms, who in the period between January 1, 2019, and the date of entry into force of this decree have been holders of occasional self-employment contracts related to the rules set out in Article 2222 of the Civil Code and who do not have a contract in place at the date of entry into force of this decree.

These persons, moreover, must not be holders of other permanent employment contracts and must not be recipients of a pension.

A bonus of 1,000 euros is also provided to temporary employees in the tourism sector and thermal establishments who satisfy the requirements listed below:

  • ownership in the period between January 1, 2019, and the date of entry into force of this decree of one or more fixed-term employment contracts in the tourism sector and thermal spas, with a total duration of at least thirty days;
  • ownership in the year 2018 of one or more fixed-term or seasonal employment contracts in the same sector for a total duration of at least thirty days;
  • no pension and no employment relationship.

Finally, the 1,000 euro bonus is due to workers enrolled in the Entertainment Workers Pension Fund who have at least 30 daily contributions paid from January 1, 2019, to the date of entry into effect of this decree and from which derives an income not exceeding 50,000 euros.

This bonus is also paid to workers enrolled in the Pension Fund for Performing Arts workers with at least 7 daily contributions paid from January 1, 2019, to the date of entry into force of this decree, resulting in an income not exceeding 35,000 euros.

The benefits referred to in this article cannot be added to each other and cannot be added to the benefits referred to in article 14.

The application for the benefits listed above shall be submitted to the INPS by November 30, 2020, using an application form prepared by the same Institute.
