Smart working and coronavirus emergency

The Decree of the President of the Council of Ministers approved on 2020, February 25th (DCPM), has simplified the access to smart working in some regions of Italy for a limited period of time, in order to cope with the health emergency created as a result of the spread of the contagion from Covid-19 (c.d. coronavirus).
As laid down by Article 2 of the DCPM, the choice of “smart work” is applicable, provisionally, until 15 March 2020, for employers based legally or operationally in Emilia-Romagna, Friuli Venezia Giulia, Lombardy, Piedmont, Veneto and Liguria and for workers residing or domiciled in those regions who carry out work outside these territories.
In accordance with the principles established by the Law 81/2017 it can be activated by sending a self-certification by the employer stating that the smart worker belongs to one of the risk areas indicated by the DPCM.
Smart-working is a way of executing the subordinate employment relationship characterized by the absence of hourly or spatial constraints and organized by stages, cycles and objectives, established by agreement between employee and employer; a way that helps the employee to reconcile life and work times and, at the same time, promote the growth of his productivity.
